Dapster

1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your access to and use of the Dapster mobile application ("App"), operated by Dapster ("we," "us," or "our").

By downloading, registering, or using Dapster, you confirm that:

• You have read, understood, and agree to these Terms.
• You are at least 18 years of age.
• You have the legal capacity to enter into a binding agreement.

If you do not agree to these Terms, you must not use the App.

2. Eligibility and Age Restriction

• By using the App, you confirm you are at least 18 years old.
• We reserve the right to terminate any account we have reason to believe belongs to a person under 18, without prior notice.
• Users must not misrepresent their age during registration or onboarding.

3. Account Registration

• You may register using your Google account, or by creating a username and password directly within the App.
• You are responsible for keeping your account credentials (Google account access, or your username and password) secure and confidential.
• You must not share your account or allow others to access it.
• You must not create more than one personal account.
• You are responsible for all activity that occurs under your account.
• You agree to provide accurate information during onboarding (name, date of birth, gender, location, preferences).
• Dapster reserves the right to suspend or terminate accounts that violate these Terms.

4. Personas and Profile Content

Dapster allows users to express themselves through personas — curated digital identities used to interact within the app.

Permitted:

• Creating a persona with a chosen name, bio, photos, and preferences.
• Uploading your own photos or photos you have explicit rights to use.
• Expressing yourself creatively through your persona.

Not Permitted:

• Impersonating a specific real person (celebrities, public figures, or private individuals) in a way that could deceive or mislead others.
• Uploading photos of third parties without their consent.
• Using photos that contain nudity, explicit sexual content, graphic violence, or hate symbols.
• Creating personas intended to harass, stalk, or harm other users.
• Using AI-generated images that realistically depict and identify a specific real person without their consent.

All profile photos are subject to content moderation. We reserve the right to remove any content that violates these Terms.

5. Acceptable Use

You agree NOT to use Dapster to:

• Harass, bully, threaten, intimidate, or harm any other user.
• Send spam, unsolicited commercial messages, or chain messages.
• Engage in any form of scamming, phishing, or financial fraud.
• Solicit money or financial information from other users.
• Share, distribute, or promote illegal content of any kind.
• Share explicit sexual content, non-consensual intimate images, or content that sexualizes minors in any form — zero tolerance policy.
• Use the App for prostitution, escort services, or any form of commercial sexual activity.
• Reverse-engineer, decompile, or attempt to extract the source code of the App.
• Use bots, scripts, or automated tools to interact with the App.
• Circumvent, disable, or interfere with security features of the App.
• Attempt to gain unauthorized access to other users' accounts or data.
• Post content that promotes violence, terrorism, or discrimination based on race, ethnicity, religion, gender, sexual orientation, or disability.

6. Matching and Interactions

• Dapster uses a swipe-based system to connect users with mutual interest.
• A Match is created only when both users have liked each other.
• Matched users may communicate via 1:1 chat.
• Unmatching or blocking a user will immediately end the chat connection.
• We do not guarantee any specific number of matches or interactions.

7. Messaging and Chat

• Dapster provides 1:1 messaging between matched users and group chat functionality.
• You may send text messages, audio messages, audio-once messages, and images within chats.
• View-once media (timed images) are supported; screenshots or screen recordings of such content without consent may violate other users' privacy and our policies.
• Audio-once messages may be played only once by the recipient.
• Disappearing messages may be enabled per conversation.
• We do not actively monitor private messages but may review content reported by users for policy violations.
• Do not use chat to share personal financial information, passwords, or other sensitive data.

7a. Anonymous Chat and Reveal

• Certain conversations may begin anonymously. In these cases, a display alias is shown instead of your profile name.
• Either user may send a Reveal Request to voluntarily share their profile with the other person.
• A Reveal only takes effect when both users consent. You will never have your identity disclosed without your agreement.
• You must not use anonymous chat to harass or deceive other users.

7b. In-App Games

• Dapster includes optional interactive games between matched users: Truth or Dare, Role-Play scenarios, and This-or-That.
• Game content is user-initiated. Both users must be matched before games are available.
• Some game content (particularly Spicy and Romantic Role-Play scenarios) contains adult themes. By using these features you confirm you are 18 or older.
• Game interactions are subject to our Acceptable Use policy. You must not use game features to harass, coerce, or send unsolicited explicit content.
• We reserve the right to remove game scenarios or restrict access to game features for users who misuse them.

7c. DAP ID

• Each account is assigned a unique Dapster Display ID (DAP ID).
• You may share your DAP ID to allow others to find and send you a connection request outside of the standard swipe feed.
• You are not required to share your DAP ID. It is visible only in your own profile settings.

8. Diamonds and In-App Currency

• Dapster features a virtual currency called "Diamonds" used for in-app features such as Super Chat.
• Diamonds have no real-world monetary value and cannot be redeemed, exchanged, or withdrawn for cash or any other currency.
• Diamonds are non-transferable outside the App.
• We reserve the right to modify, adjust, or discontinue Diamonds at any time without liability.

9. Premium Subscriptions and In-App Purchases

• Dapster offers optional Premium subscription plans (1 month, 6 months, 12 months) that unlock additional features.
• All purchases are processed through Google Play Billing.
• Subscription pricing is displayed in the App before purchase.
• Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before renewal through Google Play settings.
• Some Premium features (such as paid group access) may include a 3-day free trial for new Premium subscribers. The trial converts to a paid subscription automatically unless cancelled before the trial period ends.
• Refunds are governed by Google Play's refund policy. We do not offer additional refunds beyond those provided by Google Play.
• We reserve the right to change subscription pricing with reasonable notice.

10. Location Services

• Dapster uses your device location to show you nearby users and improve match relevance.
• Location access is requested with your explicit permission.
• You may disable location at any time in your device settings, though this may limit functionality.
• We do not share your precise location with other users — only an approximate distance is shown.

11. Identity Verification

• Dapster offers an optional identity verification feature where users may submit a selfie for review.
• Verified accounts receive a visible badge on their profile.
• Verification is reviewed by our moderation team and is not a guarantee of identity accuracy.
• Submitting false or misleading verification materials may result in permanent account termination.

12. Groups

• Users may create or join group chats within Dapster.
• Dapster organises group boards into themed categories. Some categories contain adult or sexually explicit content and are accessible only to users who are 18 or older (enforced at account level).
• Certain group boards support anonymous posting. Posts made anonymously are still subject to these Terms and our content moderation policies.
• Groups may run interactive polls. Votes are recorded and visible to group members.
• Premium users may access a 3-day free trial for paid group features. After the trial period, continued access requires an active Premium subscription.
• Group creators are responsible for ensuring their group complies with these Terms.
• We reserve the right to remove any group or board category that violates our policies, with or without prior notice.

13. Content Moderation and Reporting

• Users may report any profile, message, or content that violates these Terms using the in-app reporting feature.
• All uploads are subject to automated content moderation.
• We may remove content, warn, suspend, or permanently ban users found to be in violation of these Terms.
• Severe violations (such as CSAM) will be reported to relevant authorities.

14. Intellectual Property

• The Dapster name, logo, design, and all App content created by us are our intellectual property and may not be used without permission.
• By uploading content (photos, text, audio) to Dapster, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and process that content solely for operating and improving the App.
• You retain ownership of content you upload.
• You represent that you have the rights to any content you upload.

15. Privacy

Your use of Dapster is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it to understand how we collect, use, and protect your data.

16. Disclaimer of Warranties

• Dapster is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.
• We do not guarantee uninterrupted, error-free, or secure operation of the App.
• We are not responsible for the conduct of other users on the platform.
• Dating and social interactions carry inherent risks; you engage with other users at your own discretion.

17. Limitation of Liability

To the maximum extent permitted by applicable law, Dapster and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the App.

Our total liability to you for any claim arising from use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.

18. Termination

• You may delete your account at any time through the App settings.
• We reserve the right to suspend or permanently terminate your account for violation of these Terms, without notice.
• Upon termination, your access to the App and its features will cease.
• Provisions of these Terms that by their nature should survive termination will continue to apply.

19. Changes to These Terms

• We may update these Terms from time to time.
• We will notify you of significant changes via the App or email.
• Continued use of the App after changes take effect constitutes acceptance of the revised Terms.

20. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms or use of the App shall be subject to the exclusive jurisdiction of the courts located in India.
